The present article analyzes the existing case-law of the European Court of Human Rights (ECtHR) which pertains to cultural heritage protection and access to cultural heritage. While this case-law is often criticized for seeing cultural heritage issues too narrowly through the prism of interferences with the right to peaceful enjoyment of property under Article 1 of Protocol 1 to the European Convention on the Protection of Human Rights and Fundamental Freedoms (ECHR), the article argues that the impact of this case-law is not negligible.

In a balanced and clear method, the article addresses the development of the protection of towns and urban planning after 1989 with regard to the previous period. The introductory part of the article addresses the actual formation of institutional protection of historic town centers in the 1950's, which coincided with the establishment of the first heritage reservations and the establishment of programs for their comprehensive recovery.
